Subject: Euroceptics on EUdebate2009.eu ?

Dear Euroceptics,

I am the community manager of cafebabel.com, the European magazine written in six languages.

Recently we have launched a second site dedicated to the European elections in June: www.EUdebate2009.eu. As it is designed to be a space that raises substantial debates around European issues, I am looking for enhanced contribution of bloggers who are skeptical of the EU action and the direction in which it moves.

* Would you be interested in opening a blog on our site or contributing with some opinion pieces on current issues?

* I propose a link to your blog on our main page in exchange for adding links and logos of EUdebate2009.eu / cafebabel.com on your blog.

*From next month on I am writing a weekly European blog review on Euronews.net and I am happy to include your contribution.

Hope to hear from you soon,

Ole

  1. Ar fi cam complicat sa posteze cineva regulat in engleza.

    http://www.village.ie/Politics/EU/Lisbon_Treaty:_Charter_of_Fundamental_Rights/

Previously the ECJ dealt primarily with economic issues. But under Lisbon it would also rule on our human rights, greatly expanding its remit. [..]

    Limitations
The Charter proclaims social rights such as rights to health care and education. Yet it also states that it “does not establish any new power or task for the Union”. Thus the status quo in Ireland – such as our two-tiered health care – would not be effected by this Charter.

In the legal interpretation of the Charter by the ECJ, not only Art.97b TFEU and Art.52 of the Charter but also the case law of the ECJ would give primacy to the market. The ECJ has stated „…The fundamental rights recognized by the Court are not absolute, … Consequently, restrictions may be imposed on the exercise of those rights, in particular in the context of a common organization of the market, provided that those restrictions in fact correspond to objectives of general interest pursued by the Community …’

The right to strike, for example, could also be restricted by the ECJ. Art.52 of the Charter gives the ECJ the power to limit any rights provided such limitations “meet objectives of general interest recognised by the Union or the need to protect the rights and freedoms of others”. These “objectives of general interest” include free movement of goods or capital; “others” could mean employers, or scabs brought in to undermine a strike. The Laval case shows how the right to strike would be interpreted, in competition with “freedom to conduct a business” (Art.16 of the Charter).
